Scope and acceptance of the GTC

The content of the contract concluded between us – in addition to the provisions of mandatory laws – is determined by these General Terms and Conditions (hereinafter: GTC). Accordingly, the GTC includes the rights and obligations of You and us, the conditions for the conclusion of the contract, the deadlines for performance, the delivery and payment terms, the liability rules, and the conditions for exercising the right of withdrawal.

The technical information necessary for using the Website, which is not contained in these GTC, is provided by other information available on the Website.

You are obliged to familiarize yourself with the provisions of these GTC before finalizing your order.

Language of the contract, form of the contract

The language of contracts falling under the scope of this GTC is English.

Contracts falling under the scope of this GTC are not considered written contracts and are not recorded by the Seller.

Prices

Prices are in euros. The Seller sells without VAT for tax-exempt sales, so there is no VAT included in the prices. Prices are for informational purposes only. It cannot be ruled out that the Seller may change the prices for business policy reasons. Price changes do not apply to contracts already concluded. If the Seller has incorrectly listed the price, the GTC will act according to the “Incorrect Price Procedure” point for already concluded contracts.

In case of incorrect price

The following are considered obviously incorrectly listed prices:

EUR 0 price,

price reduced by a discount, but incorrectly listed (e.g., Offered Goods for EUR 10 with a 20% discount listed at EUR 5).

In case of incorrect price listing, the Seller offers the option to purchase the Goods at the actual price, based on which the Buyer can decide whether to order the Goods at the actual price or cancel the order without any adverse legal consequences.

Complaint handling and enforcement options

The consumer may submit consumer complaints regarding the Goods or the Seller’s activities using the following contact details:

The consumer may orally or in writing submit a complaint to the business, which pertains to the behavior, activities, or omissions of the business related to the distribution or sale of goods to consumers.

The business must immediately investigate and remedy oral complaints. If the consumer disagrees with the handling of the complaint or immediate investigation is not possible, the business must immediately record the complaint and its position on it and provide the consumer with a copy of it in person in the case of orally communicated complaints or, in the case of orally communicated complaints via telephone or other electronic communications service, send the consumer a substantive response within 30 days, simultaneously with the response to a written complaint, in accordance with the requirements for responding to a written complaint. Otherwise, the business must act as follows regarding written complaints. Upon receipt of the written complaint, the business – unless otherwise provided by directly applicable legal acts of the European Union – must, within thirty days of its receipt, respond in writing in a substantiated manner and take measures to ensure the communication of the response. Shorter deadlines may be provided by law, and longer deadlines may be provided by law. The business must justify its refusal of the complaint. The business must assign a unique identification number to orally communicated complaints. The response must inform the Buyer of the possibility of resorting to the Arbitration Board.

The minutes of the complaint must contain:

the name and address of the consumer,

the place, time, and method of submitting the complaint,

a detailed description of the consumer’s complaint, a list of documents, documents, and other evidence presented by the consumer,

the business’s statement on the consumer’s complaint, if immediate investigation of the complaint is possible,

the name of the person taking the minutes and – except for orally communicated complaints communicated by telephone or other electronic communications service – the signature of the consumer,

the place and time of taking the minutes,

in the case of orally communicated complaints communicated by telephone or other electronic communications service, the unique identification number of the complaint.

The business must retain the minutes of the complaint and a copy of the response for three years and present them to the supervisory authorities upon request.

In the event of rejection of the complaint, the business must inform the consumer in writing about which authority or arbitration board, depending on the nature of the complaint, the consumer may initiate proceedings. The information must also include the address, telephone and internet contact details, and postal address of the competent authority or arbitration board, as well as whether the business will use the arbitration board to settle consumer disputes. If the consumer dispute between the Seller and the consumer is not resolved during negotiations, the following enforcement options are available to the consumer:

Consumer protection proceedings

Complaints can be lodged with consumer protection authorities. If the consumer observes a violation of consumer rights, they are entitled to submit a complaint to the consumer protection authority competent for their place of residence. After the complaint is reviewed, the authority decides on the conduct of consumer protection proceedings. The first-instance tasks of consumer protection authorities are carried out by the capital and county government offices competent for the consumer’s place of residence, and the list of these offices can be found here: http://www.kormanyhivatal.hu/

Court proceedings

The client is entitled to enforce their claim arising from a consumer dispute in court proceedings under the Civil Code of 2013 (Act V of 2013) and the Code of Civil Procedure of 2016 (Act CXXX of 2016).

Arbitration proceedings

We would like to inform you that you have the right to file a consumer complaint against us. If we reject your consumer complaint, you have the right to turn to the Arbitration Board competent according to your place of residence or habitual residence: a condition for initiating proceedings before the arbitration board is that the consumer attempts to settle the dispute directly with the relevant undertaking. At the request of the consumer, the arbitration board designated by the consumer’s request is competent instead of the competent authority.

The undertaking is obliged to cooperate in the arbitration board procedure. Within this framework, undertakings are obliged to send a response to the arbitration board’s request, and the obligation to appear before the arbitration board ( “ensuring the presence of a person authorized to conclude an agreement at the hearing”) is also recorded as a commitment.

If the registered office or branch office of the undertaking is not registered in the county where the arbitration board competent for the area operates, the obligation of cooperation of the undertaking extends to offering the possibility of concluding a written settlement corresponding to the consumer’s claim; participation in the arbitration board session is not mandatory if a written document containing a settlement offer is sent.

In case of breach of the above-mentioned cooperation obligation, the consumer protection authority has jurisdiction, according to which, due to changes in legislation, mandatory fines are imposed in case of unlawful conduct of undertakings, and there is no possibility to waive the fine. In addition to the Consumer Protection Act, the relevant provisions of the Act on Small and Medium-sized Enterprises have also been amended, so fines will not be exempted in the case of small and medium-sized enterprises either.

The amount of the fine can range from HUF 15,000 to HUF 500,000 for small and medium-sized enterprises, while for enterprises subject to the Accounting Act with an annual net turnover exceeding HUF 100 million, it can range from HUF 15,000 to 5% of the annual net turnover of the undertaking, but not more than HUF 500 million. With the introduction of mandatory fines, the legislator aims to emphasize cooperation with arbitration boards and ensure active participation of undertakings in arbitration proceedings.

The arbitration board has jurisdiction to settle consumer disputes outside of court proceedings. The task of the arbitration board is to attempt to reach an agreement between the parties for the settlement of consumer disputes, and in case of failure, to make a decision in the matter in order to ensure the simple, fast, efficient, and cost-effective enforcement of consumer rights. At the request of the consumer or the undertaking, the arbitration board provides advice on the rights of the consumer and the obligations of the consumer.

The arbitration board procedure is initiated at the request of the consumer. The application must be submitted in writing to the chairman of the arbitration board: the requirement of written form can be met by letter, telegram, telex, or fax, as well as by any other means that allows the recipient to store the data intended for him for the period appropriate to the purpose of the data and to display the stored data in unchanged form and content. The application must include:

– the name and address of the consumer,

– the name, registered office or relevant branch of the undertaking involved in the consumer dispute,

– if the consumer has requested another arbitration board instead of the competent arbitration board, the designation of the requested board,

– a brief description of the consumer’s position, the facts supporting it, and their evidence,

– the consumer’s statement that the consumer has attempted to settle the disputed matter directly with the undertaking,

– the consumer’s declaration that the consumer has not initiated proceedings before another arbitration board, no mediation has been initiated, and no application has been made for the issue of a summons or payment order,

– a motion for a decision by the board,

– the consumer’s signature.

The application must be accompanied by the document or its copy (extract) to which the consumer refers as evidence, especially the undertaking’s written statement rejecting the complaint, in the absence of which any other written evidence available to the consumer about the attempt at settlement is available.

If the consumer acts through an authorized representative, the authorization must be attached to the application.

Out-of-court procedure of conciliation for persons not classified as consumers

Under consumer protection law, concerning the conciliation procedure of the Conciliation Board, a consumer is considered to be any entity that acts for purposes outside its independent occupation and economic activity, including but not limited to legal entities defined by separate laws, such as sales and purchase contracts, civil organizations, religious legal entities, housing cooperatives, condominiums, micro, small and medium-sized enterprises, which acquire, order, receive, use, or benefit from goods, or are recipients of commercial communications or offers related to goods.

The existence of consumer status shall be subject to verification and examination by the Conciliation Board. The rules of the procedure shall be governed by the regulations set forth under the Conciliation Board.

Online dispute resolution platform

The European Commission has established a website where consumers can register, allowing them to resolve their online purchase-related disputes by filling out a request form, thereby avoiding court proceedings. This enables consumers to enforce their rights without being hindered, for example, by geographical distance.

If you wish to file a complaint regarding a product or service purchased online and do not necessarily want to resort to legal action, you may utilize the online dispute resolution tool.

On the portal, you and the merchant against whom you have a complaint can jointly select the dispute resolution body you wish to entrust with handling the complaint.

The online dispute resolution platform is accessible here: [https://webgate.ec.europa.eu/odr/main/?event=main.home.show&lng=HU](https://webgate.ec.europa.eu/odr/main/?event=main.home.show&lng=HU)

Partial invalidity, code of conduct

If any provision of the General Terms and Conditions of Business is legally incomplete or invalid, the remaining provisions of the contract shall remain in effect, and the provisions of the relevant legal regulations shall apply instead of the invalid or defective part.

The Seller does not have a code of conduct pursuant to the law on unfair commercial practices against consumers.

Correction of input errors – Responsibility for the accuracy of provided data

During the ordering process, you continuously have the opportunity to modify the data you have entered before finalizing the order (by clicking on the back button in the browser, the previous page opens, allowing you to correct the entered data even if you have already moved to the next page). It is your responsibility to ensure that the data you provide is accurate, as billing and delivery of the product are based on the data you provide. Please note that incorrectly provided email address or full mailbox capacity may result in non-delivery of the confirmation and may prevent the conclusion of the contract. If the Buyer finalizes their order and notices an error in the data provided, they must initiate the modification of their order as soon as possible. The Buyer can notify the Seller of the modification of the faulty order by sending an email from the email address provided at the time of ordering or by phone call.

Website Usage

Selecting a Product

By clicking on the product categories listed on the website, you can choose the desired product family and then individual products within it. Clicking on each product will display the product photo, item number, description, and price. When making a purchase, you must pay the price listed on the website.

Adding to Cart

After selecting a product, you can click the “Add to Cart” button to place – any number of – items in the cart without incurring a purchase or payment obligation since adding to cart does not constitute making an offer.

We recommend adding the product to your cart even if you’re not sure if you want to buy it because it allows you to see at a glance which products you’ve selected and view and compare them on one screen. The contents of the cart can be freely modified until the order is finalized by pressing the “Finalize Order” button – items can be removed from the cart, additional items can be added, and the quantity of desired items can be changed.

When you place the selected product in the cart, a separate window will pop up with the text “Product added to cart.” If you do not wish to select any more products, click the “Proceed to Cart” button! If you want to review the selected product again or add another product to the cart, click the “Back to Product” button!

View Cart

During website usage, you can always check the contents of your cart by clicking on the “View Cart” icon at the top of the website. Here, you can remove selected products from the cart or change the quantity of items. After clicking the “Update Cart” button, the system will display information corresponding to the data you’ve modified, including the prices of the items in the cart.

If you do not wish to select additional products and add them to the cart, you can proceed with the purchase by clicking the “Order” button.

Providing Customer Information

After pressing the “Order” button, the content of the cart and the total purchase price for the products you’ve selected will be displayed. In the “Shipping Service” box, you must indicate whether you prefer to pick up the ordered product in person (personal pickup) or request delivery. If you choose delivery, the system will indicate the delivery fee, which you must pay when placing the order.

In the “User Information” textbox, you can provide your email address; in the “Billing Information” textbox, you can provide your full name, address, and phone number. The system automatically stores the data provided in the “Billing Information” textbox. If you require delivery to a different address, please uncheck the box. In the “Note” textbox, you can provide additional information as needed.

Order Overview

After filling out the above text boxes, you can continue the ordering process by clicking the “Continue to Next Step” button or cancel/change the data entered so far by clicking the “Cancel” button and return to the cart contents. By clicking the “Continue to Next Step” button, you will arrive at the “Order Overview” page. Here, you can review the data you’ve previously entered, including the contents of the cart, user, billing, and shipping information, and the total amount you need to pay (you cannot modify this information here unless you click the “Back” button).

Order Finalization (Offer)

If you are satisfied that the contents of your cart match the products you wish to order and that your data is correct, you can finalize your order by clicking the “Order Now” button. The information provided on the website does not constitute a contractual offer from the Seller. For orders falling under these General Terms and Conditions, you are considered the offeror.

By pressing the “Order Now” button, you expressly acknowledge that your offer must be considered made and your statement – upon confirmation according to the Seller’s General Terms and Conditions – entails an obligation to pay. Your offer is binding for 48 hours. If the Seller does not confirm your offer within 48 hours according to the General Terms and Conditions, you are released from the obligation of your offer.

Order Processing, Conclusion of Contract

You can place an order at any time. The Seller will confirm your offer by email no later than the next business day after you’ve submitted your offer. The contract is concluded when the confirmation email sent by the Seller becomes accessible to you in your email system.

Procedure for Unclaimed Packages

If the Buyer does not claim the ordered and delivered Goods within the legal 14-day withdrawal period without providing justification to the Seller, they breach the contract concluded with the Seller, obliging them to accept the Goods and thus accept the Seller’s performance. In this case, the Seller will attempt to redeliver the Goods if they can coordinate it with the Buyer, but they may subject redelivery to payment of a delivery fee. If redelivery is unsuccessful, or it cannot be coordinated with the Buyer because the Buyer refuses to cooperate, the Seller is entitled to terminate the contract with the Buyer due to breach of contract with immediate effect and enforce the unsuccessful delivery and return costs as a penalty against the Buyer. The Parties agree that the email used by the Buyer when placing the order will be accepted as a means of communication for the termination, and they acknowledge that the date of communication of the termination is the date when the termination email becomes accessible in the Buyer’s email account.

Payment Methods

Cash on Delivery

If you wish to settle the value of the order upon receipt of the package, choose the “Cash on Delivery” payment method.

Bank Transfer

You can also settle the payment for the products by bank transfer.

Online Credit Card Payment

You can also settle the payment for the products using online credit card payment. Online bank card payments are made through Barion’s system. The bank card data will not reach the merchant. Barion Payment Zrt., which provides the service, is an institution under the supervision of the Magyar Nemzeti Bank, license number: H-EN-I-1064/2013.

Delivery Timeframe

The general delivery time for orders is up to 30 days from the confirmation of the order. In case of delay by the Seller, the Buyer is entitled to set an additional deadline. If the Seller does not fulfill within the additional deadline, the Buyer is entitled to withdraw from the contract.

Reservation of Rights, Property Rights Clause

If you have previously ordered Goods but did not pick them up during delivery (excluding cases where you exercised your right of withdrawal), or if the Goods were returned to the Seller without notice, the Seller may require payment of the purchase price and shipping costs in advance for fulfilling the order.

The Seller may withhold delivery of the Goods until they are assured that payment of the Goods’ price has been successfully completed through the electronic payment solution (including cases where the Buyer pays the purchase price by transfer in the currency of their Member State and due to conversion and bank charges, the Seller does not receive the full amount of the purchase price and shipping fee). If the price of the Goods has not been fully paid, the Seller may request the Buyer to supplement the purchase price.

Sales to Foreign Countries

The Seller does not differentiate between Buyers within Hungary and those outside Hungary but within the European Union using the Website. In the absence of specific provisions in these General Terms and Conditions, the Seller ensures the delivery/pickup of the ordered Goods within Hungary.

For purchases outside Hungary, the provisions of these General Terms and Conditions apply, with the interpretation that, according to the relevant regulations, a buyer is considered a consumer who is a citizen of a Member State, has a residence in a Member State, or is a business established in a Member State and purchases goods or uses services within the European Union solely for final consumption or acts with such intent. A consumer is a natural person acting for purposes outside their trade, business, craft, or profession

Consumer Information

Information on the Consumer’s Right of Withdrawal

Pursuant to Section 8:1 (1) paragraph 3 of Act V of 2013 (Hungarian Civil Code), only a natural person acting outside the scope of his or her profession, independent occupation, or business activity shall be considered a consumer, thus legal entities are not entitled to the right of withdrawal without justification!

According to Section 20 of Government Decree 45/2014. (II. 26.), the consumer is entitled to the right of withdrawal without justification. The consumer may exercise the right of withdrawal

  1. a) In the case of a contract for the sale of goods
  2. aa) for the Goods,
  3. ab) in the case of the purchase of several Goods, if the services for each Goods are provided at different times, for the last delivered Goods,

within the deadline of 14 calendar days from the date of receipt by the consumer or a third party other than the carrier designated by the consumer, which deadline is 14 calendar days.

The provisions in this section do not affect the consumer’s right to exercise the right of withdrawal during the period between the conclusion of the contract and the receipt of the Goods.

If the consumer has made an offer for the conclusion of the contract, the consumer is entitled to withdraw the offer before the conclusion of the contract, which terminates the binding nature of the offer for the conclusion of the contract.

Declaration of withdrawal, exercise of the consumer’s right of withdrawal or termination

The consumer may exercise his or her right of withdrawal provided for in Section 20 of Government Decree 45/2014. (II. 26.) through a clear statement to this effect or by using the withdrawal form available on the website.

Validity of the consumer’s withdrawal statement

The right of withdrawal shall be deemed to have been exercised in due time if the consumer sends his or her statement of withdrawal within the deadline.

In the case of withdrawal or termination in writing, it is sufficient to send the statement of withdrawal or termination within the deadline.

It is the consumer’s responsibility to prove that he or she has exercised the right of withdrawal in accordance with this provision.

Upon receipt of the consumer’s withdrawal statement, the Seller is obliged to confirm it in electronic form.

Obligations of the Seller in case of consumer withdrawal

The Seller’s obligation to refund

If the consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014. (II. 26.), the Seller shall refund the full amount paid by the consumer as consideration within fourteen days from the date of receipt of the withdrawal, including any costs incurred in connection with the performance, including the shipping costs. Please note that this provision does not apply to additional costs incurred by choosing a mode of transport other than the least expensive standard mode of transport.

Method of refunding by the Seller

In the event of withdrawal or termination in accordance with Section 22 of Government Decree 45/2014. (II. 26.), the Seller shall refund the amount due to the consumer in a manner consistent with the payment method used by the consumer. With the explicit consent of the consumer, the Seller may use another method of refund, but no additional charge may be imposed on the consumer as a result. The amount proportionately due from the consumer shall be determined based on the total consideration inclusive of tax specified in the contract. If the consumer proves that the amount thus determined is excessively high, the proportionate amount shall be calculated based on the market value of the services provided until the termination of the contract. Please note that we cannot accept Goods returned by cash on delivery or postage due.

Additional costs

If the consumer explicitly chooses a mode of transport other than the least expensive standard mode of transport, the Seller is not obliged to refund any additional costs incurred as a result. In such cases, our refund obligation is limited to the general shipping rates indicated.

Right of retention

The Seller may retain the amount due to the consumer until the consumer has returned the Goods or has indisputably proved that they have returned them; the earlier date shall be considered. We are unable to accept shipments sent cash on delivery or postage due.

Consumer’s obligations in case of withdrawal or termination

Return of the Goods

If the consumer withdraws from the contract in accordance with Section 22 of Government Decree 45/2014. (II. 26.), they are obliged to return the Goods without delay, but no later than fourteen days from the date of notification of withdrawal, or to hand them over to the Seller or a person authorized by the Seller to receive the Goods. The return shall be considered timely if the consumer sends the Goods before the deadline expires.

Bear the direct costs of returning the Goods

The consumer bears the direct cost of returning the Goods. The Goods must be returned to the Seller’s address. If the consumer terminates a contract concluded outside the business premises or concluded remotely or absent from the business premises, for a service to be provided, they are obliged to pay the business a proportionate fee for the service provided until the communication of termination. The proportionate amount to be paid by the consumer shall be determined on the basis of the total consideration specified in the contract inclusive of tax. If the consumer proves that the total amount thus determined is excessively high, the proportionate amount shall be calculated based on the market value of the services provided until the termination of the contract. Please note that we cannot accept Goods returned by cash on delivery or postage due.

Consumer responsibility for depreciation

The consumer is responsible for any depreciation in the value of the Goods resulting from any use beyond what is necessary to determine the nature, characteristics, and functioning of the Goods.

If, according to the applicable laws, the right of withdrawal cannot be exercised or can only be exercised subject to conditions, the Buyer shall not be entitled to use the Goods for trial purposes.

The right of withdrawal cannot be exercised in the following cases

We specifically draw your attention to the fact that you cannot exercise your right of withdrawal in the cases specified in Section 29 (1) of Government Decree 45/2014 (II.26.):

– After complete performance of the service, however, if the contract imposes a payment obligation on the consumer, this exception can only be invoked if the performance began with the express prior consent of the consumer and the consumer’s acceptance that he/she would lose his/her right of withdrawal as soon as the business fully performed the contract;

– In relation to goods or services, the price or fee of which is not influenced by the business on the money market, and depending on the fluctuations during the withdrawal period provided for exercising the right of withdrawal;

– In the case of goods not prefabricated and manufactured based on the consumer’s instructions or at the consumer’s express request, or in the case of goods clearly tailored to the consumer’s personal needs;

– In the case of perishable or rapidly deteriorating goods;

– In the case of goods sold in sealed packaging which, after opening, cannot be returned due to reasons of health or hygiene;

– In the case of goods which, by their nature, become inseparably mixed with other goods after delivery;

– In the case of alcoholic beverages, the actual value of which depends on market fluctuations in a manner that cannot be controlled by the business, and the price of which was agreed upon by the parties at the conclusion of the purchase contract, but the performance of the contract takes place only after the thirtieth day following the conclusion;

– In the case of a business contract where the business

Warranty Rights

Under what circumstances can you exercise your warranty rights?

You can assert warranty claims against the Seller in case of defective performance by the Seller, according to the Civil Code, and in the case of a consumer contract, according to Government Decree 373/2021 (VI.30.).

What rights are you entitled to based on your warranty claim?

You – at your choice – can exercise the following warranty claims:

You may request repair or replacement, except if fulfilling the claim chosen by you would be impossible or would result in disproportionate costs for the Seller compared to fulfilling another claim. If you have not requested or could not request repair or replacement, you may demand a proportionate reduction in the price, or – ultimately – withdraw from the contract.

You may switch from your chosen warranty right to another, but you bear the cost of the switch, except if it was justified, or if the Seller gave reason for it.

In the case of consumer contracts, until proven otherwise, it must be presumed that a defect discovered within one year from the date of performance of the goods or goods containing digital elements existed at the time of performance, except if this presumption is incompatible with the nature of the goods or the nature of the defect.

In the case of Used Goods, warranty and guarantee rights deviate from the general rules. In the case of Used Goods, there can also be talk of defective performance; however, the circumstances that could lead to certain defects must be taken into account. Due to wear and tear, certain defects become more frequent, and therefore, it cannot be assumed that a Used Good has the same quality as a newly purchased one. Accordingly, the Buyer can only assert warranty rights regarding deficiencies that exceed those arising from wear and tear and occur independently of them. If the Used Good is defective, and the Buyer, being a Consumer, was informed about it at the time of purchase, the Service Provider is not responsible for the known defect.

The Seller may refuse to make the goods compliant with the contract if repair or replacement is impossible, or if it would result in disproportionate additional costs for the Seller, taking into account all circumstances, including the value of the goods in perfect condition and the severity of the breach of contract.

The consumer is entitled to demand, in proportion to the seriousness of the breach of contract, a reduction in the counter-performance or the termination of the sales contract if:

the Seller did not carry out the repair or replacement, or did so, but did not meet the following conditions, either partially or in full;

the Seller must provide for the return of the replaced goods at its own expense;

if the repair or replacement requires the removal of goods that were installed in accordance with the nature and purpose of the goods – before the defect became apparent – then the obligation to repair or replace includes the removal of the unsuitable goods and the installation of the goods provided as a replacement, or bearing the costs of removal or installation.

it refused to make the goods compliant with the contract;

a repeated performance error occurs despite the Seller’s attempt to make the goods compliant with the contract;

the performance defect is so serious that it justifies an immediate price reduction or immediate termination of the sales contract; or

the Seller has not undertaken to make the goods compliant with the contract, or it is obvious from the circumstances that the business will not make the goods compliant with the contract within a reasonable time or without causing significant disadvantage to the consumer.

If the consumer wishes to terminate the sales contract due to defective performance, the Seller bears the burden of proving that the defect is insignificant.

The consumer is entitled to withhold the remaining part of the purchase price – in proportion to the seriousness of the breach of contract – until the Seller fulfills the performance in accordance with the contract and its obligations related to defective performance.

It is a generally applicable rule that:

The Seller must provide for the return of the replaced goods at its own expense;

if repair or replacement requires the removal of goods that were installed in accordance with the nature and purpose of the goods – before the defect became apparent – then the obligation to repair or replace includes the removal of the unsuitable goods and the installation of the goods provided as a replacement, or bearing the costs of removal or installation.

A reasonable deadline for the repair or replacement of the goods must be calculated from the time when the Consumer notified the defect to the business.

The consumer must make the goods available to the business for repair or replacement.

The reduction in counter-performance is proportionate if its amount equals the difference between the value of the goods received by the Consumer in the case of proper performance and the value of the goods actually received by the Consumer.

The right to terminate the sales contract based on warranty is exercised by a declaration addressed to the Seller expressing the decision to terminate.

If the defect affects only a specific part of the goods supplied under the sales contract, and the conditions for exercising the right to terminate the contract exist for those parts, the consumer may only terminate the sales contract regarding the defective goods, but may also terminate the contract for any other goods acquired together if it cannot reasonably be expected that the consumer would retain only the goods conforming to the contract.

If the consumer terminates the sales contract in whole or in part concerning some of the goods supplied under the sales contract, then:

the consumer must return the relevant goods to the Seller at the expense of the Seller; and

the Seller must immediately refund to the consumer the purchase price paid for the relevant goods, upon receipt of the goods or the documentation confirming their return.

What is the deadline for asserting your warranty claim?

You are obliged to report the defect immediately after its discovery. The defect reported within two months from the discovery of the defect shall be deemed to have been reported without delay. However, please note that beyond the two-year limitation period from the performance of the contract, you cannot assert your warranty rights.

The part of the repair time during which the Buyer cannot use the Goods for their intended purpose does not count towards the limitation period.

The expiration of the warranty claim starts anew for the part of the Goods affected by replacement or repair. This rule also applies if a new defect arises as a consequence of the repair.

If the subject of the contract between the consumer and the business is a used item, the parties may agree on a shorter limitation period; a limitation period of less than one year cannot be validly agreed upon in this case.

Against whom and under what other conditions can you assert your warranty claim?

You can only exercise your warranty claim against the manufacturer or distributor of the movable item. You must prove the defect when asserting a warranty claim.

Under what circumstances is the manufacturer (distributor) exempt from the obligation of warranty?

The manufacturer (distributor) is only exempt from the obligation of warranty if they can prove that:

they did not manufacture or distribute the Goods in the course of their business activities; or

the defect was not recognizable at the time of distribution according to the state of science and technology at the time of distribution; or

the defect of the Goods arises from the application of legislation or mandatory official regulations.

It is sufficient for the manufacturer (distributor) to prove one reason for exemption.

Please note that for the same defect, you cannot simultaneously assert warranty and warranty claims in parallel. However, if your warranty claim is successfully asserted, you can then assert your warranty claim against the manufacturer.

Warranty

Under what circumstances can you exercise your warranty rights?

Pursuant to Government Decree 151/2003 (IX. 22.) on the mandatory warranty for certain durable consumer goods, the Seller is obliged to provide warranty for the sale of new durable consumer goods listed in Annex 1 to the Decree (e.g., technical items, tools, machinery), as well as their accessories and components as defined therein (hereinafter referred to collectively as “consumer goods”).

In addition, the Seller may voluntarily offer a warranty, in which case a warranty declaration must be provided to the consumer.

The warranty declaration must be provided to the Consumer on a durable medium, at the latest at the time of performance of the goods.

The warranty declaration must include:

a clear statement indicating that in case of defective performance of the goods, the Consumer is entitled to exercise the statutory rights of warranty free of charge, and that these rights are not affected by the warranty

the name and address of the obligor for the warranty

the procedure to be followed by the Consumer to enforce the warranty

the designation of the goods covered by the warranty and

the terms of the warranty,

the purchase price of the Goods.

What rights are you entitled to and within what deadline in case of mandatory warranty?

Warranty rights

Based on the Buyer’s warranty right, you can request repair or replacement, request a price reduction in cases provided for by law, or ultimately withdraw from the contract if the obligor has not undertaken repair or replacement within the deadline corresponding to its obligation, or cannot fulfill it, taking into account the interests of the entitled party, or if the interest of the entitled party in repair or replacement has ceased.

The Buyer may assert his claim for repair at the Seller’s registered office, any branch, subsidiary, or directly at the repair service indicated on the warranty certificate.

Deadline for enforcement

The warranty claim can be enforced during the warranty period, which is determined according to Government Decree 151/2003 (IX. 22.):

one year for a sale price exceeding 10,000 forints but not exceeding 100,000 forints,

two years for a sale price exceeding 100,000 forints but not exceeding 250,000 forints,

three years for a sale price exceeding 250,000 forints.

Failure to meet these deadlines results in forfeiture of rights, however, in the case of repair of the consumer goods, the warranty period is extended from the date of submission for repair by the time during which the Buyer could not use the consumer goods due to the defect in accordance with its intended purpose.

The warranty period starts when the consumer goods are handed over to the Buyer, or if the commissioning is carried out by the Seller or its authorized representative, from the date of commissioning.

If the Buyer puts the consumer goods into operation more than six months after handover, the starting point for the warranty period is the day of handover of the consumer goods.

Rules for handling warranty claims

When handling repairs, the Seller must strive to complete the repair within 15 days. The deadline for repair starts when the consumer goods are received.

If the duration of repair or replacement exceeds fifteen days, the Seller must inform the Buyer of the expected duration of repair or replacement.

If, during the warranty period, it is determined for the first time during the repair of the consumer goods that the consumer goods cannot be repaired, in the absence of a different instruction from the Buyer, the Seller must replace the consumer goods within eight days. If replacement of the consumer goods is not possible, the Seller must refund the purchase price stated on the invoice or receipt presented by the Buyer within eight days.

By accepting the General Terms and Conditions, the Buyer agrees that information may be provided to him electronically or in any other suitable way for the confirmation of receipt by the Buyer.

If the Seller cannot repair the consumer goods within thirty days:

if the Buyer has consented, the repair can be completed at a later date, or

if the Buyer does not agree to a later repair, or has not made a statement in this regard, the consumer goods must be replaced within eight days after the thirty-day deadline has expired, or

if the Buyer does not agree to a later repair, or has not made a statement in this regard, and replacement of the consumer goods is not possible, the purchase price stated on the invoice or receipt of the consumer goods must be refunded to the Buyer within eight days after the thirty-day deadline has expired.

If the consumer goods malfunction for the fourth time, the Buyer is entitled to:

request repair from the Seller, or

request a proportionate reduction of the purchase price from the Seller based on Section 6:159 (2) (b) of Act V of 2013 of the Civil Code, or

request repair or replacement of the consumer goods at the expense of the Seller or another party based on Section 6:159 (2) (b) of Act V of 2013 of the Civil Code if the Buyer does not exercise these rights (repair, price reduction, and repair at the expense of the Seller) or has not made a statement in this regard, the consumer goods must be replaced within eight days, or if replacement of the consumer goods is not possible, the purchase price stated on the invoice or receipt of the consumer goods must be refunded to the Buyer within eight days.

Fixed installations subject to mandatory warranty under Government Decree 151/2003 (IX. 22.) or consumer goods weighing over 10 kg, or not transportable as hand luggage on mass transportation vehicles – with the exception of vehicles – must be repaired at the place of operation. If repair cannot be performed at the place of operation, the business, or in the case of a request for repair directly at the repair service, the repair service is responsible for disassembly, assembly, and transportation.

Exceptions to the warranty

The provisions regarding the handling of warranty claims do not apply to electric bicycles, electric scooters, quads, motorcycles, motorized bicycles, cars, motorhomes, caravans, trailer homes, trailers, and motorized watercraft.

However, the Seller must still strive to fulfill repair requests for these goods within fifteen days.

If the duration of repair or replacement exceeds fifteen days, the Seller must inform the Buyer of the expected duration of repair or replacement.

What is the relationship between the warranty and other warranty rights?

In addition to the warranty rights (product and accessory warranty), the warranty is also applicable. The main difference between general warranty rights and warranty is that in the case of warranty, the burden of proof is more favorable to the consumer.

During the term of mandatory warranty, the Seller’s voluntary warranty cannot contain terms that are more disadvantageous to the consumer than the rights provided by mandatory warranty rules. However, after this period, the conditions of the voluntary warranty can be freely determined, but even in this case, the warranty cannot affect the consumer’s statutory rights, including the rights based on product warranties.

Exchange Request Within Three Business Days

The institution of exchange request within three business days also applies to sales through online stores. Exchange requests can be made within three business days for new durable consumer goods covered by Government Decree 151/2003 (IX. 22.), which states that if someone submits an exchange request within three business days, the Seller must interpret this as meaning that the Goods were defective at the time of sale and must replace the

Goods without further ado.

The information regarding product warranty and statutory warranty for non-consumer Buyers does not apply. General rules of statutory warranty rights.

Non-consumer Buyer – at their choice – may assert the following statutory warranty claims: Request repair or replacement, unless the fulfillment of the claim chosen by You is impossible or would incur disproportionate additional costs for the Seller compared to other claims fulfillment. If repair or replacement was not requested or cannot be requested, You may demand a proportionate reduction in the purchase price or the Seller may rectify the defect at the expense of the Buyer, or the Buyer may have it rectified by another person, or – as a last resort – withdraw from the contract. You may also switch your chosen statutory warranty right to another one, but you bear the cost of the switch, unless it was justified or caused by the Seller. In the case of Used Goods, statutory and warranty rights deviate from the general rules. In the case of Used Goods, faulty performance can also be discussed, but the circumstances that the Buyer could expect certain defects must be taken into account. Due to wear and tear, certain defects may become more frequent, therefore, it cannot be presumed that a used Good has the same quality as a newly purchased one. Accordingly, the Buyer can only assert warranty rights regarding deficiencies that exceed those arising from wear and tear and occurred independently of them. If the used Good is faulty and the Consumer Buyer was informed about it at the time of purchase, the Service Provider is not responsible for the known defect. In the case of non-consumer buyers, the deadline for asserting statutory warranty rights is 1 year, starting from the date of performance (delivery).

Product warranty

The product warranty and mandatory warranty only apply to consumer buyers. If the Seller provides voluntary warranty for a given Product, it will be indicated separately at the time of purchase. If the manufacturer provides a manufacturer’s warranty applicable to non-consumer buyers for the Product, it can be asserted directly with the manufacturer.
